Welcome to "The College Club" website. Below you will find the terms and conditions ("Conditions") for the purchase and return of our products ("Products"). By using the website and purchasing our products you accept these Conditions, so please read them carefully and if you do not agree with the Conditions and Privacy Policy, do not use the website. The College Club reserves the right to review and update the Conditions from time to time, such changes will be published in this section of the website.

1. OUR DATA

Purchases through this website are carried out under the name “The College Club” represented by Ana Cristina Sánchez González, residing in Barcelona.

2. YOUR DATA

The information and personal data you provide will be treated in accordance with our Data Protection Policy and our Legal Notice. By using this website and giving your express consent, you authorize us to process this information and data and declare that all the information you provide is true and corresponds to reality.

3. USE OF THE WEBSITE

The use and/or purchase of the The College Club’s Products, whose characteristics are described on the website (hereinafter referred to as "Products"), implies acceptance as a customer (hereinafter referred to as "Customer or User") of the Terms & Conditions contained herein, as well as the Special Conditions which may apply to the purchase procedure.

By using our platform, the User declares to be over 18 years old and to have enough legal capacity.

4. PURCHASING PROCEDURE

4.1. ORDER PLACEMENT

Orders will be placed by following the steps below:

Selection of the products: The user will select the Products, as well as the size and model desired, and will add them to the cart, where the quantity and Products of the order will be displayed.

Processing the order: Once you have reviewed the contents of the order, you must click on the "process order” option. The total price of the order will also be displayed (including taxes), which will include both the price of the Products and the shipping costs.

Registration of delivery and invoicing data: The customer must verify that the data are correct and true.

Registration of bank details for payment: The client will be directed to the secure payment screen managed by the Stripe platform. Payments can only be made online by credit or debit card and Paypal.

Once the payment has been made, the user will receive an e-mail with the confirmation of the order together with the details of the order ("Ticket of purchase").

The College Club reserves the right not to validate any order in the following cases:

  • abnormal or abusive claims,
  • abnormal orders in relation to the quantities ordered,
  • abnormal or abusive changes and returns,
  • existing litigation with the client

4.2 PAYMENT

Payment is made online by card (debit, Visa, Mastercard) or via Paypal. After validation of the order on the website, authorisation of the card payment will be requested, except in cases where the servers are not available. The College Club may request a new authorisation for payment in the event that the first authorisation could not be made because the servers are not available.

We have a secure online payment method that allows you to encrypt your bank details. The data is transferred in accordance with the highest security standards, guaranteed by the Stripe platform.

5. SHIPPING AND RETURNS

Delivery of orders is via courier. Delivery times are provided as guidelines only and do not take into account possible delays caused by payment authorization and/or product availability. 

According to the stock , all orders are usually dispatched within 2 working days. Kindly note that dispatch times may increase during high demand periods. 

Delivery times are 3-5 working days from dispatch of order. 

The College Club delivers to Spain (peninsula) and the Balearic Islands. We do not ship to the Canary Islands, Ceuta and Melilla.

5.2. RETURNS

The College Club, accepts the return and/or exchange of its products within a maximum period of 14 days from the receipt of your order, provided that the Product has not been used and retains the original labelling and packaging.

For any change, return or other post-sale management, it will be necessary to present the receipt of payment by card or order confirmation.

Before returning the order, you must send an e-mail to the address, so that you can be provided with the necessary information for the return, including the address to send the Products. Use the purchase electronic ticket, together with the information that will be provided to you via e-mail. Stick the duly filled document on the outside of the package, always on the protective packaging provided by your carrier (with a shipping method that has proof of delivery).

To start the process of returning orders purchased on the website you must send the Product to the address provided by email 

Once The College Club receives your shipment and checks the date of purchase and the state of condition of the Product we will proceed to refund your money if:

  1. The Product has not been used.
  2. The Product is in perfect conditions of cleaning and conservation.
  3. Be returned in the original packaging and without any modification.

5.3. CANCELLATION RIGHTS

The Customer may cancel his order without any reason within 14 calendar days; beginning on the day you received the Products without giving a reason. In the case of having purchases more than one Product, the period will be counted from the day on which the last of the Products contained in the order was delivered. This right shall not be applicable if the Product has been manufactured according to any specifications you have supplied us with (Customized Product).

The Customer must inform the decision to cancel the order by sending the request to the following e-mail address: shipping@thecollege.club

The College Club will confirm in writing receipt of the application and details of how to proceed with the refund. The College Club will not own the returned Product until it is received at the provided “return address”. The costs of return transport will be borne by the Customer.

The College Club will verify the state of condition of the returned Products. If the Product has not been unsealed and retains its original packaging, or if the Product being returned is in its original opened packaging, removed from the packaging or unpacked but in perfect state of condition. If the Products are in perfect condition, The College Club will refund the amount paid for the Products within 14 days after the return.

If, on the other hand, the products to be returned have been handled in such a way that they have suffered any kind of deterioration that reduces their value, due to the fact that they have been handled in a way that is not consistent with that required to check the nature, characteristics and/or condition of the products, this will mean that in such cases the exercise of the right of withdrawal will not be admitted.

5.4. RETURN OF DEFECTIVE PRODUCTS

In the event that the User considers that the Product does not comply with the stipulations of the website, at the time of delivery, he/she should contact The College Club by sending an e-mail to the following address: contact@thecollegeclub.com

In this mail, the user must provide the damage suffered by the product, as well as its data. You will then be given the necessary information for its return.

Once returned, The College Club will examine the returned Product and, within 14 days of receiving it, will inform the User whether or not the Product should be replaced.

6. DELIVERY AND NON-DELIVERY 

The Products shall be deemed delivered at when the User or a third party acquires possession of the Products. Said acquisition shall be proved by the signature of the receipt of the order at the address provided by the Customer for this purpose.

In the event of not being able to deliver the Products to the agreed address, the courier company will contact the Customer to inform him of the place of collection of his order. After 15 days since the Products have been available (that is, since they are available for delivery) without having been delivered, we will understand the Customer has withdrawn from the contract and will consider it terminated.

7. RISK AND OWNERSHIP

The Customer shall assume the risk of the Products from the delivery time. The customer will acquire ownership of the Products when The College Club receives full payment for the ordered Products, including shipping costs, or at the time of delivery if it takes place after the payment.

8. PRICES

The purchase prices in force at the time the order is placed are those displayed on the website including VAT (where applicable). Shipping costs are excluded and will be added to the total amount during the purchase procedure.

9. FORCE MAJEURE

The College Club will not be responsible for the performance of any obligations under these Terms and Conditions in the case of an event outside of its reasonable control (force majeure), including (but not limited to) strikes, lockouts, failures of third party systems or networks,  fire, earthquake, storm, flood or other natural disaster, civil unrest, acts of terrorism, deliberate sabotage of or malicious damage to equipment or data or for damage to or destruction of premises or equipment, regulations or governmental policies and shortages of supplies and services.

10. MODIFICATION THE TERMS AND CONDITIONS 

We reserve the right to make changes to our website, our policies and these Terms & Conditions at any time.

You will be bound by the terms and conditions, policies and Conditions of Sale in force at the time you place your order, unless, by law or by requirement of public authorities, a change to those terms and conditions, policies or these Conditions of Sale is required (in which case, such changes may be applicable to any orders you have previously placed).

If any of these conditions is declared invalid, null and void or for any reason whatsoever ineffective, such condition shall be deemed to be excluded without affecting the validity and enforceability of the remaining conditions.

11. LANGUAGE

In the event of any discrepancy between the Spanish version of these Conditions and other language versions on the website, the Spanish version shall prevail.

12. APPLICABLE LAW AND JURISDICTION

The use of our website and contracts for the purchase of products through this website shall be governed by Spanish law.

Any dispute arising out of or in connection with the use of the website or such contracts shall be subject to the non-exclusive jurisdiction of the Spanish courts. If you are contracting as a consumer, nothing in this clause will affect the rights that as such are recognized by current legislation
